Canadas Explosives Act and Regulations control the importation, manufacture, storage and sale of commercial explosives. The term explosives covers a wide variety of products, including blasting explosives used for mining and construction, fireworks, small arms cartridges and many other specialized items. The legislation is outdated (written before 1920) and difficult for stakeholders to navigate, understand (archaic language, layout not conducive to easy interpretation) and determine obligations. This
has led NRCans Explosives Regulatory Division (ERD) of the Explosives Safety and Security Branch (ESSB) to undertake a fundamental revision of the Regulations, a project that has been ongoing for several years and is now close to completion. The modernized Regulations will better reflect existing industry practices and standards and how regulators address industry issues. This initiative will clarify regulatory intent through better structure and clearer, simpler language, use modern regulatory concepts and reflect evolving technologies and business practices.
ERDs intent is to publish the proposed Regulations in the Canada Gazette 1 on March 17, 2012 and provide for a 75 day period for final public comments and feedback. During this consultation process, we will collect feedback from our stakeholders to ensure that we consider their concerns and recommendations to the maximum extent possible.

After comments are received and evaluated (which may result in changes) the Regulations will then be published in Canada Gazette 2 and come into effect in early January of 2013. At this time, a list by category of the comments and feedback with accompanying responses will be made available on our website. Once the regulations come into force, please be assured that accompanying guideline documents and updated Frequently Asked Questions (FAQs) will be made available to ensure that our industry
stakeholders are provided with all information required for a seamless transition to the new Regulations.
